Tattoos And Prisons - An Inseparable Bond!















Tattoos have been associated with criminals and on closer look you will find that most criminals have tattoos on them. These are referred to as prison style tattoo. A prison tattoo design is different from the regular tattoo that you see around.

However, the beginning of tattoos being linked with offenders is a far outcry from the style statement it is making today. For a long time tattoos were used as a means to identify criminals. With one look the person could easily be identified as an offender, at times even the person's crime would be known by just looking at the tattoo. In Germany during the Nazi reign, tattoos were used amongst the arrested Jews.

Today, however, the prisoners use tattoos to show their link to a particular gang or to show their solidarity amongst a few other prisoners. It can also be to make them a little more daunting. The tattoo gun is prohibited inside the prison but this is hardly a hurdle for those who know how to find a loophole. It is very easy to make a tattoo gun with things easily available inside the prison such as needles, shavers and the like. All one needs is a motor and you are in business.

As it is difficult to get ink inside the prison most of the prison tattoo design would be made in either black or blue. Ink is made in a crude fashion by melting rubber or candles. This is then mixed with water and used. In case a motor is not available the whole process becomes very slow as compared to a tattoo gun. But in the absence of a motor, the tattooing process is very quiet as it should be in a prison.

If some prisoner is not part of a gang, chances are he would be part of one before he comes out of the place. Gangs give a person a feeling of brotherhood that they share with other gang members. The police give special attention to the prison style tattoo as this helps in identification of criminals at a later date. They can also be identified to a particular gang. In a nutshell, tattoos play a major part in crime solving.

With the popularity of tattoos today a prison style tattoo is being flaunted by even those who have never spent a day behind bars. A prison tattoo design done in any color other that black or blue is definitely not an original one. A prison tattoo design is very big and bold, made to make a statement. If one wants to get a prison style tattoo it is important that a proper study be done or else you might send out a message which you do not intend doing. The "swastika" is probably the most popular among these tattoos.

The lifestyle of prisoners is one major concern as irresponsible sexual behavior and drug abuse is a major part of their lives. Such people are at high risk to be infected with diseases such as AIDS. Therefore, one must be careful while getting a prison tattoo design made as it is a means for spreading diseases. An infected needle can easily do this as it penetrates into the skin. Tattooing should be done only in well-respected places where hygiene is given top priority.

Russian Prison Tattoos - The Brutal Truth

In reality, the history behind Russia's criminal underground was spawned from a generation of men who, due to the economical collapse of the Soviet Union, were left with nothing - turning to crime for a means of survival. As communism fell and the safety net was removed, many of the desperate ended up in Russian prison camp system, also known as the Soviet gulag, which to this day is known as one of the most infamous and hellish prison systems in history. It was within these camps that a new breed of professional criminal was born. A criminal network based on discipline, tradition and more importantly, rank.

Russian Mafia Tattoos are more than a statement...

As these networks of seasoned Russian criminals began to establish themselves from both sides of the prison walls, they would tattoo religious and neo-nazi symbols all over their bodies as a form of recognition amongst their fellow peers, but also as a means of living with their sins. It was not unheard of for Russian Mafia Tattoos to be forcefully inked on an individual whom was deemed to be untrustworthy, or an individual who was a child molester or rapist - which went against the strong religious undertones of that time.

Common symbols and their meanings...

To the naked eye most of these tattoos represent religious imagery, such as cathedrals or monasteries, but as the Russian Mafia began to migrate to New York, Philadelphia, and Florida between the 1970's and 1990's, the American authorities and secret services began to decipher the code which lies beneath these markings of worship. They realized that not only was there a system behind Russian Mafia Tattoos, but these criminals would literally use these symbols as a business card to whom the other was, and more importantly, what sins they've committed.

Cathedral or Church - Depending on the number of towers a particular tattoo has, it usually refers to the number of years, or amount of times that individual has been incarcerated.

Cobweb - Usually designated for someone who has committed murder.

Cat or Cats - If there is a tattoo of a single cat, this means that the individual was a thief before being imprisoned. If there are multiple cats this means that the individual was part of a gang of thieves.

Stars - This seems to be the most recognized tattoo in the mainstream media. If the owner has stars on each of his knees, this mean's he will never bow down or never be brought to his knees. Stars on the shoulders are usually awarded when a particular individual has reached a criminal status or high ranking within the network - such as a Captain. Different types of stars mean different things as well.

What's even more frightening, and sad, is that in modern day Russia it is estimated that 70% of the upper echelon of society, politics and law enforcement is controlled by the Russian Mafia families and criminal networks. It is said that the same percentage of banks are also ran by the mob in Russia. The fall of communism turned a once powerful and formidable competitor into a country so corrupt that it's highest offices are products of crime. It's common amongst society for people to associate criminal organizations with the Italian Mafia, but the reality is that if you ask anyone who knows anything on this topic they will tell you that compared to the Russian Mafia, Italian crime families are like pre-school - there is no comparison.

Prison Tattoos--Links & Notes

Since we are a global society, I will include foreign tattoos, tats, tacs, tatuajes, and so forth. Plus the pictures are better. Below: Russian prison tattoos: note "onion" domes, icon-style saints. Supposedly the number of domes corresponds to the number of years sentenced. We also have skulls, spiders, angels. What are universal themes? What does cultural affinity add? What is communicated, besides, "bad-ass"?



Not a post: a collection of links and notes, working toward some background. Most of the tattoos will be covered in their respective prison gangs. These are general links and notes about tattoos that may cross gang lines, even racial lines, to be universal. (Updated December 10, 2009.) Asterisk ** denote the best refs.

Definition:
When you see the picture of a prisoner covered in tattoos, you can't assume all of them are prison tattoos.
A prison tattoo, the way I would define it, is
a. a tattoo received in prison, within one of the unofficial markets within the incarceration system, of any subject or purpose.
b. a tattoo that showed affiliation to a prison gang, acquired in or out of prison. Okay, now that I have that figured out: You'd have to ask in order to be sure.

How It's Done: These tattoos are made "on the run" so to speak, since they are forbidden by most or all departments of correction. It's a severe penalty to be caught with the equipment or a component of the equipment. This means some of them are incredibly detailed, with fine shading from a lot of hand work, and others are crude, with lines of wavering thickness and quality.

The struggle of prison tattooing doesn’t end there. Any tattoo artist caught slinging ink in prison is in for 15 days Solitary Confinement while all of his earnings are confiscated.
So that pretty much explains why tattoo artists in prison make some decent change and are in such high demand."

--Ink: cigarette ash; paper ash, residue of burned plastic, (such as the burned end of a toothbrush) the carbon from inside a battery, or soot mixed with shampoo, according to this site; ball point ink, soot from burned styrofoam cups, according to this one; basically, whatever is available. large chunks are cut up with a razor to fine them down. This explains why most prison tats are either black, grey, or blue.

--Video, Prison Tattooist: Ted Koppel makes nice in prison, eventually interviewing a tattoo artist. This guy says they do it for rememberance, heritage, art, or out of boredom. He tells you how he makes a tattoo gun. This discussion, almost 4 minutes, varies in the range of truthfulness. e.g., payment is discussed, but barter is left out. The best video I found so far, but maybe not the best explanation.

Risks:
--Sharing needles, including tattoo needles, puts one at risk for Hepatitis or HIV. The hands, needles, or other equipment is rarely sterilized. In 2008, the Centers for Disease Control also became worried about a rise in resistant-staph infections including prison communities: called MSRA. The symptoms generally start as a skin infection, but can spread to joints and to the lungs.
Between the expense, the penalties, and the health risks, a prison tattoo is a sign of massive commitment.

The "Key" to the Tattoo Message:
First: there's conflicting information. This may mean "regional variations" or it could be that the information is coming from "unreliable witnesses." So, the key should be taken with a grain of salt. No one research site will give you everything, and the best researchers always say that.

The tear, open, closed, half-open: this has become rather muddied. The open tear means somebody you love died on the outside. The closed tear means you killed somebody (thus avenging, directly or indirectly, a dead family member on the outside). Or, not. The half-filled tear is newer, and replaces the "kill sign" which now could mean anything. Celebrities are now getting this tattoo.
The tear under the left eye: People Nation. The tear under the right eye: Folk Nation.

The clock with no hands: time stands still. Prison time.
The eight ball: Bad luck. Like, you had bad luck or you are bad luck? Have to check the context.
The gravestone: Tombs with numbers for the amount of time served.
Skull: killed someone. Or, somebody likes skulls, probably not indicative alone.


The spiderweb
: means 'stuck', doing time. Some say the number of rungs is the number of years sentenced. It's believed in white supremacy tattooing, that the spiderweb on an elbow means you murdered someone. This guy looks like he served eight and then got into meth . . . .

    Though it is not of my concern - I see that you want to file a divorce with your current spouse and then remarry another person - while I don't know your personal specific situation - I would suggest that you must try and work it out with your current spouse

    I see a lot of divorce cases these days among the immigrant community and when we look into it further - many cases divorces could have been avoided if spouses were more accomodating.

    I have questions on the facts of your case, you say that a recruiter signed a contract on your behalf?, how is that possible?, the contract would then be between the recruiter and your employer, unless you signed a separate contract with the recruiter agreeing to certain terms and conditions, also it is not clear if your recruiter is in the US or in Phillipines, many other aspects are not very clear. Therefore i gave you a general response as to what happens in these situations, if you need a more specific response to your questions, i suggest that you consult an attorney over the phone or in person, it would make more sense to look at the contract in question and then give you advice on your problem.

    Does anyone know what happens when the original hard copy of PERM is lost. Can one file 140 with just the copy that you can get online from DOL site.

    I believe that you do not have to refile just because you lost the hard copy...
    This is not a lottery ticket that if you lose, you are left with nothing..
    There must a procedure to get the same certificate reissued from DOL..
    Please do the research and let is know...

    No, I do not have a EAD or AP. I did not apply for them. I am planning to keep extending my H1 and not get into the hassle of EAD and AP every year.
    When you have chance to use EAD and AP..it is always a good option as you can recapture time on H1 if something goes wrong in later stage of GC process

    1. Can I travel to India while my H1 extension application is still pending and return to US before the current H1 expires? What will happen if the application gets approved while I am in India?

    As long as you have valid visa stamp..no problem.(H1 aprroval will not make any effect.)

    2. If I get my H1 extension approved effective April 2007 and I travel to India in Feb-March 2007 while my current H1 is still valid do I still need to get the new H1 stamped on the passport or I can enter US on the current stamped H1.

    If you are entering after April2007 and your current visa is expired then you have get VISA STAMP otherwise you can enter on current visa


    3. If none of the above is possible then can I return from India in mid-March 2007 and apply for H1 ext and still continue to stay in US if I get the receipt of H1 ext application before March 31, 2007? Yes you can.

    Hi All,

    I had a previous empoyer A > Then a Prefered Vendor B > Then a Client C.

    Now I have transferred my H1 to a Preferred Vendor X & Still working on same project with the Client C, but with a different contract all togeather.

    Preferred Vendor X > the Client C

    Now the issues is , my previous employeer A is harassing me ( Vendor B is having no problems) , asking for money or filing a legal case agaist me,as I have signed a non-compete agreement with them. Can he do so ?? what can be the worst consequences?

    Hi Guys,

    I am an EB category GC applicant. I am living in US on AOS pending status and working on EAD. I don't have any other legal status in US. My previous H1 expired long back. I also changed my company after filing I-485.

    I am thinking of visiting India now. I will be carrying my I-485 receipt and my AP for this travel. My question is, can I face any difficulty while boarding a flight in India since I do not have any valid visa stamp for US in my passport? If I remember well the immigration counter in India also verifies a person's visa before letting him/her proceed on the journey.

    Also, can anybody foresee any problems while reentering at the US immigration checkpoint in such a case?

    Can somebody who traveled outside US on just I-485 receipt and AP share their experience with me?

    When i called last time when my wife EAD got approved, they told me the address on the application. So they should know.

    Did you get Soft LUD after you filed change of address? If yes, then it's probably updated.

    I did not get any soft LUD. Will all the updates happening, folks getting second FP, I wanted to make sure my case is not getting delayed due to some mistake either on their or my part. If nothing else, upon changing the address using online means, USCIS should have sent me a notice in mail at my new address to confirm the change, which I did not get. Hence the query.

    Folks,

    I am a July filer, I called USCIS last week and they stated that they need a new set of biometrics. I had initially given my biometrics after I filed my AOS last year in July 2007. According to what I have read USCIS should be able to retrieve my biometrics from their Biometric storage system. Should I call USCIS and argue with them which may be futile. Or should I just bite the bullet and await the new biometric appointment. I would appreciate any input.

    relax until the new biometrics notice comes. Chances are it never will. The CSR you spoke to probably did'nt read/know the new rules.

    My I-94 expired on Oct-10 2009 and H1B was valid till 30 Sep. 2009. Here are my questions:

    Am I an illegal resident now?

    Nope, you are not an illegal as their reply on your application will show the date as 7th December, which is not your fault.

    Until when can I stay in the us?

    The denial letter will mention the deadline for you to leave this country. Usually it is 30 days.

    Should my employer appeal the case and by when should he do that, is there premium (http://immigrationvoice.org/forum/#) processing for this?

    Yes. He should send the appeal within the time frame of 30 days. No there is no premium processing.

    How long does the appeal process take ?

    It can take anywhere from a month to a year for INS to answer the appeal. Basically appeal is done only to buy the time. Mostly its never a positive response.


    Can I work while the case is appealed?

    No. You cannot unless you have a back - up of EAD.

    How many days can I stay in us after the case is appealed?

    Till you get the verdict of the appeal.


    How do I transfer to a new employer E2 (Premium Processing) and when can I apply for the new h1b (after the case is appealed or any time)?

    There is no way you can transfer you H1-B as you old one has already expired. The only way left is applying for a new H1-b, according to my lawyer, the sooner the better. The new H1-b mostly will be a consulate case. Meaning, even though you are approved, it will be only activated once you go for visa stamping.


    What are the chances of approvals in Premium processing in Current Markethttp://images.intellitxt.com/ast/adTypes/2_bing.gif (http://immigrationvoice.org/forum/#)?

    No idea.


    Can I start working once the receipt for the new h1b petition comes in?

    No, you can only start working once it is acitvated. Meaning, once u get it stamped if it is approved as a consulate case.

    If consulate case, then you will have to get it stamp to start working.

    Can i transfer my approved I140 to a new employer ?

    I guess, if you have filed I-485 which is already past 180 days. (Check with ur lawyer)

    Have had unfortunate turn of events and need your guidance.

    I had a valid approved h1 petition and i-94 for 2005 through company A.
    Company filed for extension of h1 in 2007 and received approved h1 and i-94 valid till 2010. Did not travel out of the country at that time.

    Filed for AOS 485, EAD, AP in 2007. Traveled and entered US using AP in 2008.

    USCIS did inquiry and has revoked 2005 h1 because of incorrect LCA filing by the company. They have also said that because of incorrect LCA filing, I am in violation of h1 status. Attorneys have advised that USCIS will retroactive hold me as 'out-of-status' but not unlawful present as I was working in good faith based on an approved petition and unexpired i-94s.

    The 2007 h1 was also filed in similar fashion as the 2005 h1.
    Although USCIS has not revoked current 2007-2010 h1, there is a possibility of that happening. The 485 might be denied in that case.

    The only option is to get on h4 by applying from consulate in India.
    Since I will be now answering yes to question 38 (have you violated terms of US visa, or unlawful present..?) I have also shown as intent to immigrate based on my 485 filing.

    I want to know my chances of getting an h4 approved.

    They came through for him during a tight reelection campaign in Nevada. Now Hispanic voters are looking to Senate Majority Leader Harry Reid to return the favor.



    Reid has promised a Senate vote this year on a small piece of immigration legislation known as the DREAM Act, which would give hundreds of thousands of undocumented immigrants a conditional path to legal residency.



    "The answer is yes," Reid told Univision host Jorge Ramos in October when pressed about whether there will be a vote. "I have the right to bring that up any time I want."



    As Congress reconvenes this week for the final session of the year, Reid now has roughly a month to make good on his promise.



    Many immigrants and immigrant advocates, particularly Hispanics, have been disappointed by Congress' inaction on legislation to address the situation of millions of the country's undocumented immigrants, particularly those who are young children.



    However, Republican opposition to efforts to legalize undocumented immigrants, a packed end-of-year legislative agenda and a bleak track record for controversial bills during lame-duck sessions all cast doubt on chances of the bill's passage this year.



    The DREAM Act would grant legal status to immigrants who complete college or at least two years of military service and maintain "good moral character." It would apply to immigrants younger than 36 years old who arrived in the U.S. illegally as children under the supervision of their parents.



    "We are very confident this will come up for a vote," said Flavia de la Fuente of the adovacy group DreamActivist.org. "We are confident that the American people and that the moderate GOP will make the right choice when it comes to investing in the future of this country."



    Reid attempted to attach the measure as an amendment to the defense authorization bill in September, drawing intense protest from Republicans, who accused the Democrat of playing pre-election politics.



    Ultimately, Republicans blocked the effort to bring the defense bill to the floor for debate, precluding a chance of adding the DREAM Act. The bill also included a repeal of the military's "don't ask don't tell" policy.



    "We're going to vote on the Dream Act; it's only a question of when," Reid said after the vote. "It's a question of fairness. This is not the end of this."



    Many activists on both sides of the issue agree, however, that chances of the bill's passage are only going to grow dimmer with an influx of Republicans set to join the House and Senate in January.





    Roy Beck, president of Numbers USA, a group that favors tighter immigration controls and supports Republicans' efforts to block the DREAM Act, said the measure is flawed.



    "Some of these [immigrants] are compelling cases, no doubt about it," said Beck. "But you've got to draw some lines a lot narrower than the DREAM Act draws them. This is about giving millions of illegal aliens permanent work permits, and I don't think in this economy that this is a very happy time to be doing that."



    President Obama supports the legislation, as does Defense Secretary Robert Gates, who says it would help recruitment, and Education Secretary Arne Duncan, who says it's "the right thing to do for our country."



    But it's unclear whether the administration will push behind the scenes in the weeks ahead to make it a legislative priority. The Congress already faces challenging debates over whether to extend the Bush tax cuts, fund the federal government through 2011, and approve a controversial defense spending bill.



    "The president supports the DREAM Act and I support the DREAM Act. The president supports immigration reform, and I support immigration reform. And how Congress takes that up is for the Congress and the leadership to decide," said Homeland Security Secretary Janet Napolitano in September.



    The DREAM Act has received some bipartisan Senate support in the years since it was first introduced in 2001. It was approved as part of immigration reform bill in 2006, but the package later failed in the House. In 2007, the Act was filibustered when it came up for an up-or-down vote.



    Speaker Nancy Pelosi has decided not to list DREAM Act as a priority for this week, a senior Democratic aide told ABC News. But it could come up after Thanksgiving.



    According to the nonpartisan Migration Policy Institute, about 2 million of the nearly 11 million undocumented immigrants currently living in the U.S. could be eligible for legalization under the DREAM Act.



    The group also estimates, however, that only 825,000 of those immigrants would ultimately take advantage of the law if it were enacted.

    I have a approved I-140 (Jan 2005). My PD is March 2004 and I have already filed I-485 (filed simultaneously with 140). Now I am waiting for the PD to become current for 485 approval. My 6 years on H1 will expire in March 2007. I checked with my GC lawyer and he said that since I have a approved 140 I can apply for a 3 year extension on H1 six months before the H1 expiry. I have to travel to India in Feb-March 2007 and so my questions are:

    1. Can I travel to India while my H1 extension application is still pending and return to US before the current H1 expires? What will happen if the application gets approved while I am in India?

    2. If I get my H1 extension approved effective April 2007 and I travel to India in Feb-March 2007 while my current H1 is still valid do I still need to get the new H1 stamped on the passport or I can enter US on the current stamped H1.

    3. If none of the above is possible then can I return from India in mid-March 2007 and apply for H1 ext and still continue to stay in US if I get the receipt of H1 ext application before March 31, 2007?

    I am not sure if you need an extension ..since you have already applied for 485..you should have a EAD which is authorization to work and you must have applied for AP which is required for travel..and you dont need a stamp to enter back in case you have an Advance Parole..

    Hi All,
    I am thinking of looking for other job options. I want to know if you any one of you have changed jobs on EAD and your experience with the whole issue.


    1. Did you find have any issues when getting 485 approved.

    2. Did you file AC21.

    3. Does the job responsibility has to meet 100% word by word.

    4. Has any one you applied for EAD extension on your own.

    5. Has any one got an RFE after changing the Job on EAD and submitting AC21. if so what kind of questions do they ask.

    Hello,

    My PERM ad was placed and the lawyer said there are responses and company will have to take recruitment steps before he can file.

    Company say he has done recruitment and sent report to lawyer. Lawyer says no, I have not received recruitment report. What is this recruitment report ? Is the PERM application not strong if there are responses.

    I am really struggling between lawyer and company. Any thoughts. They seem to be dodging me after taking money. If i have some details from experinced gurus, I can talk to them. Else, they just delay after taking legal fee.

    my EAD is about to expire on may 6th. I applied for EAD renewal in january , i had around 90 days. My application package along with the cheque came back to me after 1month because I forgot to sign the application form.. Dumb right....
    Then i signed my form and send it back to TSC . So i was in a bad situation becuase my employer said if i do not get my EAD card before it expires, they will have to lay me off. So here is what i did , i contacted my local Congressman's office through their website and raised a request to expedite my case and stated if i do not get my EAD i will loose my job.
    Surprisingly i got a mail from the congressman office that they are looking into my case and they will take it forward... and after a week i got a mail from USCIS saying my case is approved . So if someone is in my kind of situation its better to go through congressman or senator rather than info pass all that route.. Politics and politicians speak in a different language and so it always wins!!!

    Can H1 visa stamp be used for travel convenience ?

    I am EB3 India with PD of August 2001. I 140 approved but cant file I 485 due to retro. I have sent in my application for 8th -10th yr H1 extension. I am already Canadian PR landed in April 2005 so basically need to do something in early 2008 if I still need to hold on to my Canadian PR. I have worked for same firm since last 7 + yrs and they are quite cooperative within limits.

    I wanted to know if I can work for my company's Canadian operations and still hold H1 visa and travel on that H1 visa. Please note that I will be on Canadian payroll. Is this legal ? Is it ok for the company to keep extending my H1 ? I know they can keep my Green card case alive but what about H1 ?

    Is it ok to stay outside US and get paid outside US and still use H1 visa to travel ?

    I got the 140 denial notice.
    The USCIS did not mentioned any reason like my valid labour is expired.Not sure is the denial is because of 180 day rule or not.

    Here is the reason...

    The petitioner did not submit an individual labour certification for the beneficiary or evidence of schedule A designation.As such, the beneficiary is ineligible for classification as a member of the preofessions holding an advanced degree or an alien of exceptional ability.

    there is no proof (valid labor) that you are eligible for EB2. since you labor is expired, there is no labor and you can not proceed with 140 - so they denied your 140

    I think the first line "The petitioner did not submit an individual labour certification for the beneficiary..." is relevant to your suspicion of an expired labor. It effectively says that there are no valid labor certification against your I140 application, which means that the Labor certification you filed your I140 against, is not valid anymore.

    Please restart your Labor again, ASAP.

    I always did paper filing. I have done it third time this time. Incidently, the first two times the EAD approval came in about 17 days but this time, it has already been 15 days and I have not received the receipt even. The check was withdrawn on the 13th day.

    I am in the same situation. I have read through the 485 Adjudicator's Manual and would infer that if you are working for the petitioning employer, the employment letter may be RFE. I am still searching for more information on this issue and will post if I find anything.

    I filed my 485 application on July 2nd. But my employer/lawyer did not attach the employment verification letter in the package. Is USCIS going to reject my application because of that or they will send an RFE. Please advise..

    I would recommend to extend H1-B, if the employer is paying for it. Extended travel on AP is tricky, but its not an issue with H1-B. If there is no extended travel plans (e.g. Working for three months from another country, or 3 month leave spent in another country etc), then there is no advantage to have H1-B.

    An interesting question may be, if this will count towards the lifetime cap of 12 years of H1B? That I don't know.

    Hello All,

    I was reading at some of the posts in this forum and they seem to have been quiet helpful.

    My company has decided to go ahead with my GC process.
    Its in the very early stage, but my immigration specialist gave me a heads up regarding something.

    She said, that as I have a 3 yrs BE degree the USCIS may not recognize me under EB2 category :confused: So I explained her the education system in India, but she said that it depends upon the Credential Evaluation Agency which will process my educational qualification and prepare a report and submit it to USCIS.
    Following this USCIS will make a decision whether to grant EB2 or EB3 category.

    I am sure many of the members may have faced a similar Dilemma....Is there any specific solution to this?

    To be precise I completed my Diploma from Mumbai & Degree from Pune University, followed by MS in US and currently working on H1B.

    Please Advice.

    Hi,

    My wife is on H4 and I am on H1. We both have EAD. How ever, I have not converted to EAD and intend to be on H1 till i get my GC. Also our H4 and H1 3 year extensions are pending with CSC. My wife has a job offer for which she will need to use her EAD. The question is:


    1) Can she change her status to EAD while her H4 extension is pending ?

    2) Will her working on EAD jeopardise her H4 extension adjudication ? We want to maintain valid H4 as a backup.


    3) What is the process for her to convert from H4 to EAD. Do we have to inform uscis ?

    4) Is required, can she change her status form EAD to h4 (if we maiantain valid H4 as well)


    Your quick response is appreciated. Thank You.

    I am so confuse and cursing myself why did I leave US. My apartment, my car , my belongings every thing is back in US and I am stuck here

    First of all, calm down. Everything will be just fine. If you stress out, you burn your own brain cells.


    So my understanding is that if I file for CP then I would be asked to interview in home country for my GC and it could take long once again if it gets stuck in name check.

    Yes, that is correct. If you file for CP, your approved I 140 gets forwarded to the consulate and then consulate will process it (if PD is current) and give you interview. They WILL do the name check and if it is not cleared for H1, it is not likely to be cleared for GC. so they will not give interview till your name check is cleared and PD is current.

    But if I wait for H-1 name check clearance then I could enter to US and apply for I 485 and even if it takes longer than 6 months, I would get I 185 approved.



    That is correct. There is not time limit after approval of I 140 to file 485. You can file it any time after I 140 is filed and if you are stuck there due to name check, you have a reason for the delay as well (just in case someone asks in future; but no one is supposed to ask it any way). So by all means you will be able to file 485 once you enter US on H1. It can be any amount of delay. The only things is; your PD needs to be current at that time.

    The thing is I am not sure how long it would take to get my name check clearance so I am thinking of CP.
    That is exactly why I said in the above post that that's the one thing you can do and who knows? may be name check gets cleared and if your PD is current and all stars are aligned well they may call you for interview for GC even before your H1 interview (although this is not very likely to happen!) but it would not hurt.


    Another thing is that I am on unpaid leave for last 3 months. My company let me worked for first 6 months remotely but then asked me to take unpaid leave. Would it be an issue when I go for interview for CP.


    Entirely unrelated question. To make it clear, let me ask you: Were you IN US during that 3 months unpaid leave and you were on H1?? in that case you were out of status for those three months. If that is the case, that might come in your way if they notice it. They may even deny H1 stamp on that basis. and they can raise that during CP interview as well. Talk to your lawyer. If this is the case, it may be safe to go through the route of first getting H1 stamp, come to US and file 485. (once you enter on a valid stamp, all prior out of status violations are sort of forgiven and so they will not create any problem at 485 stage)

    Let's assume that if I get interview for CP after a year, wont they ask that I am not working for my current company so why are they doing CP for me.

    You dont have to be working for the sponsoring employer at the time of either 485 approval or at the time of CP approval. All you need to have is a letter from employer that says, they will hire you permanently for the job described in your PERM on a permanent basis. That's it. And you and your employer should have good faith intention to do so once GC is approved. GC is for the future job.


    And one more thing how long does it take generally to get interview once a person has applied for CP ??

    I dont know the precise answer to this question. I think once they receive notification from DOS (which by itself takes few months); they do name check, local police clearance etc and once those things are in line, and your PD is current they will call you for the interview...this may be few months.

    One of the stupid questions!!!

    If NSC had put all applications from July 2nd to July 17th on hold.
    Did they open and timestamp it ? for received date ??????

    If they did not , then I may be lucky.
    Because my package had signatures and all other dates of June 29th . The day when we were planning to ship the package, but for july fiasco.

    Do you guys think ? they might see this and enter it as received date ?

    The online status of my package on USPS tracking page shows same message as yours. It just struck me that how can a certified mail be delivered to the agency if one is sending it to a PO Box. I mean how can USPS get a delivery signature from a real person if the address is not a physical address, but a PO Box number. Any thoughts?

    I dont know if other Folks have seen the same thing. My renewal EAD application has reached Texas (TSC) today June 5th around noon by USPS Express Mail but the status says
